Welcome to Samewave.
These Terms of Service ("Terms") form an agreement between you and Juequan xu ("we," "us," or "our") governing your access to and use of Samewave.
Please read these Terms and the Samewave Privacy Policy carefully before using Samewave.
Samewave is an AI-powered music generation and personal music management application. Samewave may provide Sign in with Apple, music creation using Your Idea, generation parameters, AI-powered music generation, a private Library, playback, Favorites, Downloads, iOS system sharing, VIP subscriptions, generation credit purchases, and account and privacy controls.
Samewave does not currently provide public community posts, comments, following, chat, rankings, Tokens, wallets, or public user-generated content features.
Samewave currently uses Sign in with Apple for account authentication. Your account may maintain your private Library, VIP status, Purchased generation credits, profile information, Favorites, Download information, and other account-level information.
You may not sell, rent, lend, or misuse your account. If applicable law requires parental or guardian authorization for you to use Samewave, you may use the service only after those requirements have been satisfied.
Samewave allows you to submit Your Idea and select Mood, Style, Duration, and Scene parameters to request AI-generated music. Generation may involve Samewave systems and a third-party AI provider.
Before your creation information is sent to the AI provider for the first time, Samewave requests separate AI Data Processing permission. If the required permission has not been granted, has been withdrawn, or must be renewed, Samewave may prevent new AI generation requests until valid permission is provided.
For a generation request, Samewave may provide Stability AI US Services Corporation with Your Idea, Mood, Style, Duration, Scene, and necessary technical request metadata.
Information submitted to the AI provider through Samewave may be retained for up to three (3) months. Samewave user data submitted through this process is not used to train AI models.
AI generation is probabilistic. Similar inputs may produce different results, and different users may receive outputs containing similar characteristics. Samewave does not guarantee that every generated result will meet your subjective expectations, be unique, never contain elements similar to existing works, or be suitable for every commercial or professional purpose.
Safety and technical checks do not constitute an absolute guarantee of originality or non-infringement.
You are responsible for information and instructions you submit to Samewave. You may not use Samewave to violate applicable law, infringe third-party rights, engage in fraud, attack or interfere with our systems, bypass payment or technical restrictions, distribute harmful code, or otherwise materially abuse the service.
Samewave may reject generation requests where reasonably necessary for safety, legal, intellectual property, or service-integrity reasons.
Samewave generates music based on your submitted parameters and stores successfully completed Tracks in your private Library. Your ability to use generated music may depend on the applicable Samewave music license, AI provider terms, applicable law, and your intended use.
Unless expressly provided under applicable license terms, Samewave does not guarantee:
A Track may become unavailable for copyright, safety, legal, licensing, or operational reasons. Samewave may disable playback, Download, or Share functionality for such a Track. Unless required by applicable law, making a Track unavailable does not automatically restore a previously consumed generation credit.
An active VIP subscription provides 3 Daily generation opportunities per server calendar day. The Daily balance resets each day at 00:00 UTC-5. Unused Daily generation opportunities do not roll over to the next server calendar day.
Purchased generation credits do not expire while your Samewave account remains active. Purchased credits are associated with the account through which they were purchased and cannot be transferred between accounts.
If both Daily and Purchased credits are available, Samewave consumes credits in the following order:

A credit is finally consumed only after:
A credit is not finally consumed for unsuccessful requests, including invalid parameters, missing or invalid AI permission, insufficient balance, successful cancellation, safety rejection, AI provider failure, network failure, timeout, offline status, or Track persistence failure. Samewave may temporarily reserve a credit while generation is processing; a reservation is not final consumption.
Samewave may offer 1 Week VIP, 1 Month VIP, and 3 Months VIP. Actual prices, currencies, taxes, and availability are displayed through Apple StoreKit and may vary by storefront.
VIP is an auto-renewable subscription. Unless cancelled within the period required by Apple, your subscription may automatically renew and Apple may charge your applicable payment method. You can manage or cancel your subscription through Apple's subscription management features.
Deleting the Samewave App, signing out, or deleting your Samewave account does not automatically cancel an Apple auto-renewable subscription.
Restore Purchases may restore an eligible active VIP subscription. Repeated restoration does not repeatedly issue Daily benefits already provided.
When VIP expires, VIP Daily benefits expire under the applicable product rules. Purchased credits are not cleared solely because VIP expires.
Samewave may offer 3, 5, or 10 generation credit packages through Apple In-App Purchase. These packages are Consumable In-App Purchases.
After a successful purchase and server-side verification, the corresponding quantity is added to your Purchased balance. Each Apple transaction issues its entitlement only once. Repeated verification does not issue duplicate credits.
Consumable generation credits are not reissued through Restore Purchases. However, Samewave may synchronize your server-verified account balance if a previously issued balance is not displayed correctly.
Buying generation credits does not make you a VIP, change a VIP expiration date, or unlock other VIP benefits.
All Samewave digital goods are offered through Apple In-App Purchase. Entitlements are issued only after the transaction has been verified and confirmed as successful. Pending transactions do not receive entitlements in advance, and cancelling a purchase does not change existing VIP or credit balances.
Refunds, revocations, Grace Period, Billing Retry, and other Apple transaction states are handled according to Apple's rules and Samewave's server verification results. If Apple refunds or revokes a transaction for which benefits were issued, Samewave may adjust the related benefits in accordance with applicable law and reasonable fraud-prevention rules.
Samewave may provide Favorites, Download, and Share features where permitted by the applicable music license and product configuration. Favorites, Downloaded, and Shared states relate to your private Track data and do not mean that music has been posted to a public community.
When you use the system Share Sheet, the third-party application or service you select may process the information you choose to share under its own terms.
Samewave depends on networks, third-party AI services, Apple services, cloud infrastructure, and other technical components. We use reasonable efforts to maintain Samewave but do not guarantee uninterrupted or error-free availability on every device, at every time, or in every region.
Where reasonably necessary, we may maintain or upgrade systems, modify interfaces or technical implementations, replace third-party providers, restrict content presenting safety or compliance risks, or modify the service to satisfy legal or platform requirements. Material changes to personal-information processing will be addressed under the Privacy Policy and applicable law.
You may not:
We may reasonably restrict requests or conduct that violate these rules.
You may submit an account deletion request through Samewave's Delete Account process. For security, we may require renewed authentication through Sign in with Apple.
Account deletion may delete or de-identify your profile, private Tracks, Your Idea, Favorites, Download metadata, Share Events, AI consent records, unused Daily credits, unused Purchased credits, and other private account data. Once a valid deletion request is accepted, Samewave will complete the applicable account deletion process within 30 days.
Deleted private data generally cannot be recovered. Unused generation credits cannot be transferred to another account. Any refund rights are determined by applicable law, Apple's refund rules, and the terms applicable at purchase.
Deleting your Samewave account does not automatically cancel your Apple auto-renewable subscription. You do not need to cancel the subscription before requesting account deletion, but you must separately cancel through Apple if you do not want renewal charges to continue.
We may restrict or terminate service where an account is involved in serious illegality, fraud, attacks, purchase-verification circumvention, or another serious violation of these Terms, subject to applicable law.
Samewave's software, interface designs, brands, trademarks, graphics, and other materials owned by us or our licensors remain the property of their respective owners. Except where permitted by law or expressly authorized, you may not copy, modify, sell, sublicense, or exploit them.
Your Idea does not transfer to us merely because you submit it to Samewave. We process it only as necessary to provide and secure the service and comply with these Terms and the Privacy Policy. Rights and licenses relating to generated music are governed by Section 5 and any applicable music license terms.
To the maximum extent permitted by applicable law, Samewave is provided as available. Because AI technology is uncertain, we do not guarantee that generated results will satisfy any particular artistic, commercial, or personal purpose.
We will use reasonable efforts to restore service after third-party service failures, network or device failures, Apple service interruptions, or other circumstances beyond our reasonable control, but we do not guarantee uninterrupted service.
Nothing in these Terms excludes or limits consumer rights or liabilities that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, liability will be determined based on actual loss, fault, causation, and applicable law. Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer-protection or other applicable law.
We may update these Terms to reflect changes to the service, applicable law, third-party providers, or our operations. Where a change materially affects your rights or obligations, we will provide notice as required by applicable law. Updated Terms take effect on the stated effective date.
