Samewave (the "App," "Samewave," "we," "us," or "our") is provided and operated by Juequan xu.
We respect your privacy and are committed to protecting your personal information. This Privacy Policy explains what information we collect and process when you use Samewave, how we use and disclose that information, how long we retain it, and the choices and rights available to you.
Please read this Privacy Policy carefully before using Samewave. When you use our AI music generation features, we may, with your explicit permission, send your music description and selected generation parameters to a third-party AI service provider to generate music for you.
Samewave currently supports account access through Sign in with Apple. When you sign in, we may receive:
If you use Apple's Hide My Email feature, we do not receive your underlying Apple ID email address through Sign in with Apple.
When you use Samewave to create music, we process information that you enter or select, including:
Your Idea is associated with your account and is treated as private creation information. It is not automatically made public to other users. Please do not include sensitive personal information in Your Idea unless necessary for your intended use.
To provide your private music collection and related features, we may process:
Your Samewave Library is associated with your account and is designed as a private music collection. Samewave does not currently provide public community feeds, public user posts, comments, following, chat, or rankings.
When you use VIP features or purchase generation credits, we may process:
Digital goods in Samewave are offered through Apple In-App Purchase. Payments are processed by Apple. We do not directly receive your complete payment card details.
We may process limited technical information necessary to operate, secure, and troubleshoot Samewave, including:
Samewave's current core functionality does not proactively require access to your precise location, camera, microphone, or photo library. If a future feature requires such access, Samewave will request the relevant system permission before accessing the applicable information.

Your creation information is sent to the applicable AI provider only when you submit a generation request and the required AI permission is valid.
Samewave uses a third-party AI service to assist with music generation. The AI provider is:

After you provide the required permission, Samewave may send:
Simply signing in, viewing your Library, or opening Create Music does not automatically send this information to the AI provider.
The information is provided to the AI provider solely as necessary to generate music requested by you and perform technical processing necessary for that generation request.
Before Samewave sends your creation information to the third-party AI provider for the first time, we provide a separate AI Data Processing Consent / AI Data Use Notice.
The permission is not pre-selected and is not bundled into login, purchase, or general acceptance of the Terms of Service.
If you choose Not Now, close the consent screen, withdraw your permission, or the permission cannot be successfully recorded, Samewave will not submit a new AI generation request using your creation information until valid permission is provided.
Information transmitted to the AI provider for music generation may be retained for up to three (3) months, after which it will be deleted or de-identified in accordance with the applicable processing arrangements.
Samewave user data submitted to the AI provider through Samewave is not used to train AI models. This includes Your Idea and the generation parameters submitted as part of a Samewave generation request.
Where required, appropriate safeguards will be applied to international data transfers.
We do not sell your personal information. We may disclose information where necessary to provide Samewave, including to:
Service providers receive only information reasonably necessary to perform their applicable services.
Samewave may provide playback and Download functionality where permitted by the applicable music license and product configuration.
When you actively select Share, Samewave may generate an export file or controlled link and open the iOS system Share Sheet. Sharing does not automatically create a public Samewave post or public profile.
Samewave may record a Share Event when the system indicates that a sharing operation was successfully completed. Cancelled or failed shares are not treated as completed Share Events.
We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy. Our standard retention periods are:
Account information is generally retained while your Samewave account remains active. When you request account deletion, account information will be processed for deletion in accordance with Section 8 below.
Certain transaction, accounting, fraud prevention, security, or other records may be retained for longer where reasonably necessary or required by applicable law. Where applicable, information may be deleted earlier when you delete the relevant content or your account.
Where available, you may delete a private Track from Samewave. Deleting a Track may remove the corresponding Track from Library, Recent, Favorites, and related account views.
Deleting a Track does not restore a generation credit that was validly consumed after the Track was successfully generated and saved.

Once a valid account deletion request has been accepted, Samewave will complete the applicable account deletion process within 30 days.
Unused generation credits cannot be transferred to another account after account deletion.
Apple Subscription Notice
Deleting your Samewave account does not automatically cancel an Apple auto-renewable subscription. If your Apple subscription remains active, Apple may continue billing you according to your subscription settings. You may manage or cancel your subscription through Apple's subscription management features. You do not need to cancel your Apple subscription before requesting deletion of your Samewave account.
Depending on applicable law, you may have rights to request access, correction, deletion, restriction, withdrawal of consent, a copy of certain information, and other privacy rights provided by applicable law.
Samewave allows you to withdraw your AI Data Permission through Settings where this feature is available. After withdrawal, Samewave will prevent new generation requests from sending applicable creation information to the third-party AI provider unless valid permission is provided again. Withdrawal does not affect processing lawfully performed before withdrawal.

Samewave is not directed to children who are not legally permitted to use the service under applicable law. Where parental or guardian authorization is required, Samewave should be used only after the applicable requirements have been satisfied.
Samewave and its service providers may process information outside the country or region where you live. AI processing regions are disclosed in Section 3.7. Where required by applicable law, we use appropriate safeguards for international transfers of personal information.
We use reasonable technical and organizational measures designed to protect information, including access controls, authentication mechanisms, transmission protections, permission restrictions, and server-side transaction verification. However, no internet-based service can guarantee absolute security.
Samewave may rely on Apple, our disclosed AI provider, and other infrastructure or technical service providers. Where those third parties independently process information, their own applicable terms and privacy policies may also apply.
We may update this Privacy Policy to reflect changes to Samewave, our data practices, third-party providers, applicable law, or our operations. Where a change materially affects your rights or how we process personal information, we will provide notice or request renewed consent where required.
